General Terms and Conditions for Ski and Snowboard Lessons
These General Terms and Conditions govern the contractual relationship between Ski & Snowboard School Sterzing – Outdoor Center and its customers for all ski and snowboard courses offered, as well as private lessons in all sports disciplines offered.
By booking a service, these General Terms and Conditions become an integral part of the contractual relationship.
1. Scope and booking
These General Terms and Conditions apply regardless of whether the booking is made online, by telephone, in writing or directly at the ski school office.
If a booking is made for several persons, the person making the booking is responsible for informing the other participants of the conditions applicable to the booking.
2. Payment, booking confirmation and entitlement to participate
All booked services must generally be paid for in advance unless a different method of payment has been expressly agreed.
Once the booking has been successfully completed, customers will receive a booking confirmation or course ticket. These serve as proof of the booking and entitle the holder to participate in the booked service.
The booking confirmation or course ticket is valid only for the service, booking period and participants specified therein and is not transferable. It must be presented digitally or in printed form upon request.
Any changes to or discrepancies in a booking must be reported to the ski school without delay and in any event before the course begins.
Online payments are processed via the payment service provider Payyo, Trekksoft AG, Baarerstraße 52, 6300 Zug, Switzerland. The respective terms and conditions of the payment service provider also apply to payment processing.
3. Course times, meeting point and late arrival
The information stated in the respective booking confirmation or course ticket is decisive for the course start time, duration and course days.
Unless a different meeting point is specified for the booked service, the meeting points for group courses and private lessons are located at the Rosskopf mountain station at the appropriately colour-coded meeting points.
Participants should arrive at the agreed meeting point at least 5 minutes before the course starts, with their personal ski equipment and ski pass.
In the event of late arrival, there is no entitlement to an extension or make-up of the missed lesson time, nor to a pro-rata refund.
4. Group courses and group allocation
Group courses are generally held with a minimum of 4 participants.
Participants are allocated to groups by the ski school, in particular according to age and skiing ability, with the aim of creating groups that are as homogeneous as possible.
The ski school may also adjust group allocation while a course is in progress if this is appropriate or necessary due to differing ability levels or for organisational reasons.
If the minimum number of participants is not reached, the ski school may merge groups, adjust the duration of lessons or the course programme, or offer another suitable solution.
If no suitable alternative can be offered and the course is cancelled by the ski school, the provisions of section 10 apply.
5. Private lessons
One private lesson unit lasts 55 minutes unless a different duration is expressly stated for the booked service.
Private lessons may be booked as individual lessons or for a private group of no more than 3 participants.
Children and adults may not take part together in the same private lesson.
Where a private lesson is shared, participants should have broadly similar skiing ability so that effective joint instruction can be provided. If ability levels differ significantly, the ski school may recommend an adjustment to the booking or lesson arrangement.
6. Minor participants / supervision and collection
The ski school's duty of supervision begins when the child is handed over to the responsible ski instructor(s) at the agreed meeting point and ends when the child is handed back to a parent or legal guardian, or to a person authorised to collect the child.
Where a collection service has been expressly booked, the duty of supervision begins when the child is handed over to the person appointed by the ski school at the agreed collection point. If return transport is also included in the booked collection service, the duty of supervision ends when the child is handed over at the agreed return location.
Parents or legal guardians are responsible for bringing their children to the agreed meeting point in good time for the start of the course and collecting them again at the end of the course. To ensure a smooth handover, they should arrive at the agreed meeting point at least 5 minutes before the course ends. Where a collection service has been booked, the agreed collection and return times and locations apply.
If a child is not collected on time, ski school staff will, where possible, supervise the child or take the child to the ski school office.
Minor participants may leave the course independently after the lesson only if their parents or legal guardians have expressly authorised them to do so. In this case, the ski school's duty of supervision ends when the booked lesson time ends.
7. Ski pass, equipment and safety
The ski pass and equipment are not included in the course price unless expressly stated otherwise for the booked service.
Participants are responsible for having a ski pass valid for the lesson and suitable, functional ski or snowboard equipment.
Participants are required to use the safety equipment prescribed by law and to hold the liability insurance required by law for the use of ski slopes.
If participation in the lesson is impossible or delayed due to a missing or invalid ski pass, missing mandatory safety equipment or unsuitable equipment, there is no entitlement to an extension, make-up lesson or refund for the missed lesson time.
Lessons away from secured pistes will only be provided if the ski school or the responsible ski instructor(s) consider this reasonable in light of the snow, weather, avalanche and safety conditions. Participants must carry and use the necessary or legally required safety equipment.
8. Cancellation by customers
Booked services may be cancelled free of charge up to 72 hours before the booked service begins. In this case, any payments already made will be refunded in full.
In the event of a later cancellation or no-show, there is generally no entitlement to a refund of the course price paid. The provisions relating to illness or accident under section 9 remain unaffected.
If a service that has already begun is voluntarily discontinued or ended early, there is likewise no entitlement to a refund for unused lesson time.
Cancellations must be made through the online booking system or communicated to the ski school in text form. Compliance with the 72-hour deadline is determined by the time the cancellation is received by the ski school.
9. Illness and accident
If a booked service cannot be used or continued due to illness or accident, the ski school will, upon presentation of a valid medical certificate, grant a refund or voucher for the lesson days or lesson units not used.
The medical certificate must confirm the inability to participate or lack of fitness for sport during the relevant period, must be issued by a local doctor and must be submitted to the ski school promptly.
Lesson days or lesson units that have already been fully used will not be refunded.
Accompanying persons, family members or other participants included in the same booking are not entitled to a refund or voucher due to the illness or injury of another person.
The validity period of any voucher issued will be stated on the voucher itself.
10. Weather, lift operations and cancellation by the ski school
Ski and snowboard lessons generally take place in all weather conditions, provided that the lesson can be conducted safely and the required lifts are operating. Cold temperatures, snowfall or fog do not, in themselves, constitute grounds for cancellation.
The ski school decides whether a service must be cancelled, interrupted or ended early due to weather, snow or safety conditions.
If a booked lesson unit, course day or booked service is cancelled by the ski school due to weather/force majeure and no suitable alternative date can be offered, the amount attributable to the cancelled service will be reimbursed in the form of a value voucher.
In the event of temporary interruptions to lift operations or short weather-related delays, there is no entitlement to an extension or refund, provided the lesson can essentially be carried out.
11. Changes to programme, courses and instructors
The ski school reserves the right, for organisational or staffing reasons, to make changes to the course schedule, course times or meeting points, provided that the essential nature of the booked service is preserved.
The ski or snowboard instructor assigned to a lesson may be changed, and such a change does not give rise to any entitlement to a refund or price reduction.
Where possible, affected customers will be informed of changes in good time.
Price changes apply exclusively to future bookings. For services that have already been booked on a binding basis, the price agreed at the time of booking remains applicable.
12. Participation requirements, conduct and liability
Participants are responsible for ensuring that they are medically and physically fit to take part in the booked service. Any cognitive, health-related or physical limitations relevant to the safe conduct of the lesson must be disclosed to the ski school or the responsible instructor(s) before the lesson begins. In the case of minor participants, this disclosure is the responsibility of the parents or legal guardians.
Participants must follow the instructions of the ski and snowboard instructors and comply with the applicable piste and safety rules. They must adapt their behaviour to their own abilities and to the prevailing snow, weather and piste conditions.
Participation in lessons while significantly under the influence of alcohol, drugs or other substances that impair safe participation is not permitted.
In the event of serious or repeated breaches of safety rules or instructions that endanger the participant's own safety or that of others, the ski school may exclude the participant from further lessons. In this case, there is no entitlement to a refund for unused lesson time.
The ski school is liable in accordance with applicable law. To the extent permitted by law, the ski school is not liable for damage caused by the participant's own fault, the conduct of third parties, or failure to comply with instructions and safety rules where such damage is not attributable to the ski school.
To the extent permitted by law, the ski school accepts no liability for the loss, theft or damage of personal belongings.
13. Complaints and claims
Complaints or objections relating to ski or snowboard lessons should be reported to the ski school as soon as possible so that, where possible, an appropriate solution can be found while the course is still in progress.
Any later complaints must be submitted to the ski school in text form and should include the relevant booking, the course date and the reason for the complaint.
14. Applicable law and place of jurisdiction
The contractual relationship is governed by Italian law. Mandatory statutory consumer-protection provisions remain unaffected.
For consumers, the places of jurisdiction provided for by law apply. In all other cases, to the extent permitted by law, Bolzano shall be the place of jurisdiction.
If individual provisions of these General Terms and Conditions are or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
